An outstanding contribution--almost certainly the most important book on its topic since Dworkin's Law's Empire. Legality develops a novel and forceful account

Law as integrity requires judges to treat the techniques that they use in interpreting statutes and measuring precedents not simply as tools handed down by the legal system, but as principles they assume can be justified in political theory, and when that is in doubt they construct a theory of the system to better them. Judges as Hercules Dworkin has drawn an analogy to regard judges as Hercules. In deciding a 'hard case', Hercules will construct a scheme of abstract and concrete principles, providing a coherent justification for all common law precedents, statutory provisions and the constitution.Dworkin in Laws Empire stated that judges who accept the interpretive ideal of integrity decide hard cases by Dworkin says that we can assume that Hercules accepts most of the settled rules of his jurisdiction, laying down the characteristics of law. 37 Supra, n , no 2 at p426 (1889) 22 NE 188 31 Supra, n , no 1 at p88 32 Supra, n , no 10 at p225 33 Waldron, J. (2009) ‘Refining the question about judges’ moral capacity’. Here, Dworkin constructs a model of such a judge called Hercules. Although Hercules is only an ideal model, judges have an obligation to aim for the right answer.

Few, if any, philosophers of law have attracted as much attention over the past 15 years as Ronald Dworkin has; controversy clings to Dworkin like metal to a magnet. Or is that only Hercules could give the right answer?  Dworkin states that there is some sort of weak discretion since each judge scheme of principle will be slightly different.

Dworkin advocates for a moral reading of the United States’ Constitution and an interpretative approximation of Law and morality. In order to defend his hypothesis and theories, he uses several explanations like the theory of the chain novel or the metaphor of the Hercules judge.

This, however, does not mean, that I absolutely reject possibility of the use of intelligent machines in judicial decision-making.
